Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the orders dated 21/12/2020 in Protest Petition No.32 on the file of the 1st respondent herein, quash the same and direct the 1st respondent herein to conduct an enquiry in Protest Petition No.32 of 2020 in the manner known to law afresh.

ORDER

The issue is that the petitioner has lodged a protest petition with the Sub Registrar, the first respondent herein as concerning the registration of a certain document pending before him for registration.

2.Mr.T.M.Pappiah, learned Special Government Pleader entered appearance for the first respondent.

3.The Sub Registrar/first respondent is now directed to hold an enquiry into the protest petition, but shall decide the issue based on the Judgment of the Hon'ble Supreme Court in Satya Pal Anand Vs. State of Madhya Pradesh & others [2016 10 SCC 767] as well as the Judgment of the Division Bench of this Court in https://hcservices.ecourts.gov.in/hcservices/

N.Ramayee Vs. Sub Registrar [(2020) 8 MLJ 305] within a period of four (4) weeks from the date of receipt of a copy of this order.
