Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent herein to depute a surveyor to inspect, survey and measure the said property and report actual measurement and boundaries of the petitioners' property in Patta No.105, ReSurvey No.202, Sub Division No.4, No.72, Moppiripalayam Village, Palladam Taluk, Tiruppur District in pursuance to the representation of the petitioners dated 07.08.2023.

ORDER

This writ petition is filed for a direction to the respondent to depute a surveyor to inspect, survey and measure the said property and report actual measurement and boundaries of the petitioners' property in Patta No.105, ReSurvey No.202, Sub Division No.4, No.72, Moppiripalayam Village, Palladam Taluk, Tiruppur District in pursuance to the representation of the petitioners dated 07.08.2023.

2. It is the case of the petitioners that they submitted a representation on 07.08.2023 with a request to survey their property, which is pending without consideration.

3.The learned Government Advocate submitted that the petitioners have not made an online application, if the same is made, the application will be considered and orders will be passed on merits within a reasonable time as fixed by this Court.

4. Heard learned counsel for the petitioner and the learned Government Advocate appearing for the respondent and perused the materials available on record.

5. By consent of both parties, this writ petition is taken up for final 2/4

disposal at the admission stage itself.

6. Considering the limited relief sought for in this writ petition, this Court without going into the merits of the case, directs the petitioners to submit an online application for survey of the property within a period of one week from the date of receipt of a copy of this Order and once the application is submitted, the respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law, after giving notice to the neighbouring land owners and any other interested persons within a period of two months thereafter.
