O R D E R

This Criminal Original Petition has been filed seeking to fix an early date to dispose the C.A.No.27 of 2017 along with C.A.No.24 of 2017 on the file of the Principal District Judge, Tiruvallur.

2. The respondent has been convicted for an offences under Section 138 of Negotiable Instruments Act and has filed C.A.No. 27 of 2017 before the Principal District Judge, Tiruvallur. The petitioner who is the de facto complainant has filed a cross appeal in C.A.No.24 of 2017, which is also pending before the Sessions Court, Tiruvallur.

3. The learned counsel for the respondent/accused submitted that the accused has filed a petition under Section 391 Cr.P.C for additional evidence and also for recalling a witnesses.

4. Taking into consideration the facts and circumstances of the case, this Court directs the Principal District and Sessions Judge, Tiruvallur to dispose of C.A.No.24 of 2017 and 27 of 2017 within three months from the date of receipt of a copy of this order. Orders in any Interlocutory Applications filed by the accused, shall be passed along with the main case. If the accused adopts any dilatory tactics the bail can be cancelled and he can be remanded to custody.
