ORDER
The case has been heard through video conference The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4 (1)(aaa) and 4(1-A) of TN Prohibition Act, in Crime No.38 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner was found in illegal possession of 110 litres ID Arrack. Hence, the complaint was registered.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.
4.The learned Additional Public Prosecutor submits that the petitioner was found in illegal possession of 110 litres ID Arrack. He https://hcservices.ecourts.gov.in/hcservices/
would further submit that the entire contraband has been seized by the respondent police. He would further submit that there is one previous case pending as against the petitioner .Hence he vehemently opposed to grant of anticipatory bail to the petitioner. 5.Taking into consideration the facts and circumstances of the case and that the petitioner has involved in very serious offence and there is one previous case pending as against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 17/02/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
