2017 to till date to the Petitioner working in Presiding College, Chennai pending WP No.26429/2017. Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.KARUNAKARAN, Advocate for the petitioner and of MR.P.
The petitioner has challenged the order of transfer, transferring him from Chennai to Mannarkudi in Tanjavur District on the ground that the same is illegal, arbitrary being actuated with malafide, wherein, notice has already been issued but admittedly, the aforesaid order of transfer has not been stayed. However, the petitioner, after such transfer having applied for medical leave, the same has not been granted to him and he has also not joined in the place of posting. But he has filed the writ miscellaneous petition to release his salary. As it appears in this case, no materials have been produced indicating the fact that the petitioner is working in any place presently or his leave has been sanctioned. As such, the prayer made to direct the respondents to release the salary of the petitioner is devoid of merit and accordingly this writ miscellaneous petition stands dismissed.
