ORDER
This Criminal Original Petition has been filed by the accused Nos.1 to 3 to direct the District Munsif cum Judicial Magistrate, Pochampalli to dispose of the case in C.C.No.66 of 2019 at early.
2. The learned counsel for the petitioners has submitted that the first petitioner has been working in a Highways Department, but he has been falsely implicated in the abovesaid case. He further submitted that a counter case has also been registered and in that case also charge sheet has been filed and based on the same, a case was taken on file in C.C.No.78 of 2019 under sections 292(b), 324 and 506(i) of IPC and the same is also pending. He further submitted that since a criminal case has been registered against the petitioner, he has been placed under suspension with effect from 15.02.2019. He further submitted that already in both the cases charges were framed and thereafter the cases were routinely adjourned and now posted to 22.04.2020 without any progress. 3. The learned Additional Public Prosecutor has fairly conceded that a counter case in C.C.No.78 of 2019 is also pending before the same court and he requests to direct the trial court to dispose of both the cases at an early date.
4. It is seen from the typed set of papers filed by the petitioners that on 13.08.2019, charges were framed against the petitioners herein and thereafter the case was adjourned to 02.11.2019. From 02.11.2019, it was adjourned to 27.01.2020 and from 27.01.2020, the case was adjourned to 22.04.2020.
5. Considering the submissions made by the learned counsel for the petitioners that the first petitioner has been working in a Highways department, because of this case, he has been placed under suspension with effect from 15.02.2019 and also a counter case in C.C.No.78 of 2019 is also pending, the trial court is directed to advance the hearing from 22.04.2020 after giving notice to both parties and examine the witnesses and dispose of both the cases within four months from the date of receipt of a copy of this order.
6. With the aforesaid directions, this Criminal Original Petition is disposed of.
