Legal representatives of J.Indra, who died on 23.09.2019, have filed this Original Petition under section 372 of the Indian Succession Act, 1925 seeking issuance of a Succession Certificate with respect to Securities and Mutual Funds mentioned in the schedule to the Petition.

2. The 1st petitioner is the husband of J.Indra and the 2nd to 6th petitioners are her son and daughters. The 1st to 5th petitioners had given consent affidavits for Succession Certificate to be issued in the name of the 6th petitioner. Paper publication had been effected. The 6th petitioner was examined herself as PW-1. The death certificate of J.Indra and her legal heirship certificate were marked as Ex.P1 and Ex.P2. The statement of holdings in the name of J.Indra was marked as Ex.P3. The consent affidavits of the 1st to 5th petitioners were marked as Ex.P10 to Ex.P14.

3. In view of the evidence recorded, I hold that Succession Certificate may be issued in the name of the 6th petitioner, 1/3

viz., J.Hemamalini, one of the daughters of the deceased viz., J.Indra to collect the securities and to receive the interest and dividends there on and negotiate and transfer the securities as specified in the schedule to the petition.

4. With the above observations, this Original Petition stands allowed.
