Crl.M.P.No.2071 of 2023 in H.C.P.No.1596 of 2022 M.SUNDAR, J., and M.NIRMAL KUMAR, J., (Order of the Court was made M.SUNDAR.J.,) Captioned 'Criminal Miscellaneous Petition' ['Crl.MP' for the sake of brevity] has been filed with a prayer for fixing an earlier date for hearing aforementioned 'Habeas Corpus Petition' ['HCP' for the sake of brevity].

2. To be noted, this is a second (such) petition, the first being Crl.M.P.No.15019 of 2022 and the same was dismissed by Hon'ble predecessor Bench on 28.09.2022. This order has not been annexed to the captioned Crl.MP and Mr.S.Jeyachandran, learned counsel for petitioner, who is before us, does not have a copy of this order. However, we took efforts, went into the official website of this Court and took out the order. We hope that such situations do not recur in the days to come. However, we deem it appropriate to take a print out of the order and reproduce the same infra. A scanned reproduction of the order is as follows:

3. The primary ground is that detenu's father has undergone a heart surgery. We find that averments are general and not sufficient to fix an early date. The other averment that co-accused were granted regular bail is hardly a consideration for fixing an early date. However, if there is any further development, it is open to the petitioner to come up with a similar/same prayer.
