These petitions have been filed (i) to condone the delay of 417 days in filing the petition to set aside the abatement caused by the death of the respondent namely Srinivasa Udayar, (ii) to set aside the abatement caused by the death of the respondent namely Srinivasa Udayar and (iii) to bring on record the legal representatives of the deceased respondent namely Srinivasa Udayar as proposed respondents.

2. Heard the learned counsel for the petitioners in all the petitions.

3. It is reported that one of the proposed second respondent namely Sabarivasan is no more hence seeks permission to withdraw these petitions and liberty may be given to file fresh applications and he has also made an endorsement in these petitions to that effect.

4. In view of the endorsement made by the learned counsel for the petitioners, the petitioners are permitted to withdraw these petitions with liberty to file fresh applications.

5. Accordingly, these Civil Miscellaneous Petitions are dismissed as withdrawn.
