Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the entire records relating to the rejection message bearing Ref.No.TN/REV/TLR/I/COLLMGDP/08DEC25/16926497 dated 08.12.2025 issued by the 1st respondent and quash the same as illegal, arbitrary and unsustainable in law and consequently directing the respondents to protect the petitioner's lawful title and possession over the lands comprised in Survey no.126/7A2 situated at Perumalpattu Village, Thiruvallur Taluk, Thiruvallur District and permit the petitioner to construct a residential house thereon without obstruction and provide adequate police protection to the petitioner to safeguard peaceful possession and enjoyment of the property against unlawful interference or threats from private individuals, with in a stipulated time as fixed by this Court.

ORDER
This Writ Petition has been filed challenging the impugned order passed by the 1st respondent, dated 08.12.2025, rejecting the petitioner's application seeking permission to construct a house in the property morefully disclosed in the prayer to this writ petition. Page No.2 of 6
2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 6. Since no adverse order is passed against the 7th respondent in this writ petition, notice to the 7th respondent is dispensed with by this Court.
3. The petitioner has challenged the impugned order on the ground that it is a non-speaking order and has been passed in violation of the principles of natural justice. He claims that he is the absolute owner of the property morefully disclosed in the prayer to this writ petition. He claims that all the revenue records are also standing in petitioner's name for the said property. Hence, he claims that permission ought to have been granted to him by the 1st respondent for constructing a house.
4. As seen from the impugned order, dated 08.12.2025, the petitioner's application seeking permission to construct a house has been rejected by a non-speaking order. Only through a whatsapp message, the petitioner has been intimated through the impugned order dated 08.12.2025 that the petitioner's application has been rejected, since the said property is earmarked for a park. No opportunity of hearing was Page No.3 of 6
granted to the petitioner in the impugned proceedings. The supporting documents filed by the petitioner along with his application seeking permission to construct a house has also not been considered. Being a non-speaking order and an order passed in violation of the principles of natural justice, necessarily, the impugned order, dated 08.12.2025 issued by the 1st respondent has to be quashed and the matter has to be remanded back to the 1st respondent for fresh consideration on merits and in accordance with law.

For the foregoing reasons, the impugned order, dated 08.12.2025 passed by the 1st respondent is hereby quashed and the matter is remanded back to the 1st respondent for fresh consideration of the petitioner's application seeking permission to construct a house in the property morefully disclosed in the prayer to this writ petition, on merits and in accordance with law, within a time frame to be fixed by this Court. While re-considering the same, the 1st respondent shall afford an opportunity of hearing to the petitioner and also consider the supporting documents produced by the petitioner and thereafter, the 1st respondent shall pass a speaking order in respect of the petitioner's application seeking permission to construct a house in the subject property, within a Page No.4 of 6
period of twelve (12) weeks from the date of receipt of a copy of this order.
