Writ Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing 1st to 3rd respondent for taking an appropriate action against the 5th respondent, who is operating with the intention to create perplexity in the residents and fraudulently extorting money from the public by falsely claiming to have registered an association with a fake registration number in the Koladi Anbu Nagar Area, and to prevent the 5th respondent and his office bearers to enter into petitioners association at 120, Muthumariamman Koil Street, Anbu Nagar, Koladi, Thiruverkadu, Chennai-600 077 and maintain peace and protect law and order problems among the residents of Anbu Nagar area based on petitioner's representation dated 17.01.2026 with aid of the 4th respondent police within stipulated time may be fixed by this Honble court.

ORDER

The Writ Petition has been filed for the following relief: To issue a Writ of Mandamus, directing 1st to 3rd respondent for taking an appropriate action against the 5th respondent, who is operating with the intention to create perplexity in the residents and fraudulently extorting money from the public by falsely claiming to have registered an association with a fake registration number in the Koladi Anbu Nagar Area, and to prevent the 5th respondent and his office bearers to enter into petitioners association at 120, Muthumariamman Koil Street, Anbu Nagar,

Koladi, Thiruverkadu, Chennai-600 077 and maintain peace and protect law and order problems among the residents of Anbu Nagar area based on petitioner's representation dated 17.01.2026 with aid of the 4th respondent police within stipulated time may be fixed by this Honble court.

2. The petitioner seeks to ventilate a private dispute with the rival Association through this Writ Petition.

3. It is seen that the grievance raised by the petitioner pertains purely to a private dispute between the parties. The appropriate remedy available to the petitioner is only by way of a Civil Suit and not by invoking the writ jurisdiction of this Court under Article 226 of the Constitution of India. Further, the dispute between the parties involves disputed questions of fact.

4. It is also seen that the petitioner had earlier lodged a complaint before the Police against the fifth respondent. After enquiry conducted by the Police Officials, they had withdrawn the complaint stating that they would resolve their dispute before the competent Civil Court. This undertaking was given on the enquiry held on 03.02.2025.

5. Suppressing the said fact, the present Writ Petition has been filed. Hence, this Court is not inclined to entertain the Writ Petition. Accordingly, the

Writ Petition is dismissed. The petitioner shall approach the Civil Court to redress their grievances. No costs.
