Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus, directing the first respondent to recover a sum of Rs.56,722.50 contemplated in C.P.No.248 of 2005 and as per the certificate issued by the Government in G.O.(D) No.7 dated 06.01.2009 of Labour and Employment (c) Department from the 3rd respondent management and disburse the same to the petitioner.

The present writ petition has been filed by the petitioner seeking for a Writ of Mandamus, directing the first respondent to recover a sum of Rs.56,722.50 contemplated in C.P.No.248 of 2005 as per the certificate issued by the Government in G.O.(D) No.7 dated 06.01.2009 of Labour and Employment (C) Department from the third respondent management and disburse the same.

2. According to the learned counsel for the petitioner, as per the G.O.(D) No.7 dated 06.01.2009 of Labour and Employment (C) Department, the third respondent company has to disburse a sum of Rs.56,722.50/- along with the interest at the rate of 6% to the petitioner. However, the third respondent has not yet disbursed the said amount to the petitioner and he has also submitted several representations before the 1 & 2 respondents. However, till date, no steps have been taken by the respondents. Aggrieved by the same, the petitioner has come before this Court with the present writ petition.

3. Mr.M.R.Raghavan, learned counsel appearing for the third respondent circulated a letter dated 27.06.2022 before this Court stating that the respondent management is willing to settle the matter by payment of Rs.1,00,000/- (Rupees one lakh only) in toto.

4. The aforesaid submission made by the learned counsel appearing for the third respondent has been fairly conceded by the learned counsel for the petitioner.

5. Heard the submissions made by the learned counsel appearing on either sides and perused the materials available before this Court.

6. In view of the above submissions made, the third respondent management is directed to pay the sum of Rs.1,00,000/- (Rupees one lakh only) to the petitioner within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of with the above direction. No costs.
