Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to measure the lands bearing Door No.83, Alwarpet, Coonoor, having acquired title by the petitioner under Sec.13(12) of the SARFESI Act read with Rule 8 and 9 of the Security Interest (Enforcement) Rules, 2002, by a Registered Sale Deed dated 21.8.2017, registered on 9/1/2018 as Document No.40 of 2018.

ORDER

This Writ Petition is filed for a writ of Mandamus, directing the 1st respondent to measure the lands bearing Door No.83, Alwarpet, Coonoor, having acquired title by the petitioner under Sec.13(12) of the SARFESI Act read with Rule 8 and 9 of the Security Interest (Enforcement) Rules, 2002, by a Registered Sale Deed dated 21.8.2017, registered on 9/1/2018 as Document No.40 of 2018.

2.Mrs.R.Janaki, learned Additional Government Pleader entered appearance for the first respondent and submitted that an enquiry is scheduled to take place on 12.03.2021 at 3.00 p.m at the office of the first respondent.

3.The said statement of the learned Additional Government Pleader is recorded.

4.In view of the above, no further direction is required to be given except that the first respondent is directed to issue notice to all the parties who are likely to https://hcservices.ecourts.gov.in/hcservices/

be affected by his decision, provide them a fair and effective hearing and to dispose of the matter through a speaking order within a period of twelve (12) weeks from the date of receipt of a copy of this order, subject to the period, if any lost for the responsibilities associated with the conduct of the General Elections, 2021.

5.The Writ Petition is disposed of accordingly. No costs.
