Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to remove the encroachments in the entire Power House Road, Villupuram, and also direct the respondents to stop further encroachments in the Power House Road, Villupuram. ORDER

(made by SENTHILKUMAR RAMAMOORTHY, J.) The petitioner complains of alleged encroachments on Power House Road, Maruthur Village, Villupuram District.

2. It is asserted by the petitioner that he is a small farmer living in Maruthur Village. It is further asserted that the agricultural lands at Maruthur Village are situated at the end of Power House Road, which is, consequently, the main access road for carrying agricultural produce. According to the petitioner, several persons with a political background have encroached on the Power House Road and put up bathrooms and toilets thereon. In spite of submitting representations on 28.12.2020 and 11.01.2021 to the District Collector, Villupuram, no action has been taken thereon.

3. Mr.V.Jayaprakash Narayanan, learned State Government Pleader, accepts notice on behalf of all the respondents and states that respondents 3 and 4 are the appropriate authorities to take action on the petitioner's representation.

4. In the aforesaid facts and circumstances, without examining the merits of the representation dated 11.01.2021, the respondents 3 and 4 are directed to consider the representation dated 11.01.2021 and dispose of the same by a reasoned order after providing a reasonable opportunity to all parties affected thereby. The aforementioned reasoned order shall be issued within a period of eight weeks from the date of receipt of a copy of this order.

5. W.P.No.8407 of 2021 is disposed on the above terms. There will be no order as to costs. Consequently, connected WMP.No.8955 of 2021 is closed.
