ORDER

This Criminal Original Petition has been filed challenging the proceeding in CC No.31 of 2024 pending on the file of the learned Judicial Magistrate, Tirukkoyilur and to quash the same.

2. Heard the learned counsel on either side and perused the materials placed on record.

3. The learned Government Advocate (Crl.Side) would submit that the prosecution had examined all the prosecution witnesses and the matter is posted for Investigation Officer's evidence. At this stage, the entire proceedings cannot be quashed.

4. Therefore, this Court is not inclined to quash the proceeding in CC No.31 of 2024 pending on the file of the learned Judicial Magistrate, Tirukkoyilur. The petitioner is at liberty to raise all the grounds before the trial Court. Considering the petitioner that he is a differently abled person, the personal appearance of the petitioner is dispensed with and he shall be represented by a counsel after filing appropriate application. However, the petitioner shall be present before the Court at the time of furnishing of copies, framing charges, questioning under Section 351 of BNSS and at the time of passing judgment. The trial Court is directed to complete the trial within a period of twelve weeks from the date of receipt of copy of this Order.
