C.M.P.No.2360 of 2023 in P.T. ASHA, J, The above petition is filed by the respondents in the above Second Appeal to admit the following documents: "(i) Certified copy of the decreetal order in H.M.O.P.No.123 of 2001 dated 31.01.2006.
(ii) Certified copy of the Judgement in H.M.O.P.No.123 of 2001 dated 31.01.2006.
(iii) Copy of the Family Card details of appellant.
2. Despite the drafted notice being served on the appellant, he has not appeared in the above matter.
3. In the affidavit filed in support of the said petition, the 1st respondent had stated that since she has not received proper legal counsel, she was not able to file the present documents earlier. 1/3
Thereafter, when she has engaged the present counsel and discussed the matter, she was adviced about the importance of the documents and the need to file the same as an additional documents. The first and second documents are orders of Court and the third document is the Family Card, all of which are public documents. Therefore, the present petition has been filed. It is also brought to the notice of this Court through the affidavit that she is an illiterate women coupled with the fact that she did not have proper legal counsel earlier.
4. In view of the above, the petition is ordered as prayed for and the documents are taken on file and marked as Ex.B.3 to Ex.B.5.
5. The Registry is directed to post the Second Appeal for hearing on 23.02.2023.
