as ineligible for such promotion, advance his date of promotion as Special Sub Inspector of Police to the date of actual completion of 10/5 years of service as per GO.Ms.844 dated 03.06.1997, G.O.Ms.937 dated 21.07.1998 and G.O.Ms.15 dated 07.01.2010 and fix the petitioners pay in the scale of pay applicabl to Special Sub Inspector of Police on completion of 25 years of service w.e.f. 01.09.1996 and further promote the petitioner as Sub Inspector of Police w.e.f. 01.06.1997 and award selection grade in the post of Sub Inspector of Police .

This writ petition is filed seeking direction for the respondents to consider the petitioner's representation dated 8.1.2015 and to issue deeming promotion to the petitioner as Sub Inspector of Police on par with his juniors namely Angappan, Devraj, Ramapandian and M.A. Kaliyamoorthy who were called for the range promotion board for the year 1995-1996 and promoted as Regular Sub Inspector of Police on 19.9.1995 and further promoted as Inspector of Police w.e.f. 2.3.2005 and step up his pension by fixing notional pay and allowances or alternatively in case he is considered as ineligible for such promotion, advance his date of promotion 2/5

2.When the matter was listed for hearing on 10.10.2023, none appeared on behalf of the petitioner. Again the matter was listed on 19.10.2023 and again none appeared on behalf of the petitioner on that day. Thus, this Court passed an order, directing the Registry to list the matter on 30.10.2023 under the caption "For Dismissal". Even today also i.e on 30.10.2023, when the matter is called, there is no representation on behalf of the writ petitioner.
3. Learned counsel for the respondent would submitted that as per the Judgment in Writ Appeal No.3748 of 2019 dated 04.02.2022 of this Court, the issues raised in this writ petition have already been resolved and thereby, perhaps the petitioner is not interested in prosecuting the present 3/5
writ petition.
4. Thus, it is evident that the petitioner is not interested in pursuing the matter. Accordingly, the Writ Petition stands dismissed for nonprosecution. No costs. Index : Yes 30.10.2023 Speaking Order (sha) To
