Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing respondents to extend the leave for 30 days from 07.02.2024 to the detenue, Thangadurai, aged about 36 years, S/o Rajan, convict prisoner, bearing Convict No.22621, confined at Central Prison, Coimbatore in WP No.1005 of 2024 order dated 22.01.2024.

ORDER

(Order of the Court was made by M.S.RAMESH, J.) When the petitioner's brother had sought for grant of Ordinary Leave for the convict prisoner, we had granted leave from 24.01.2024 to 07.02.2024 through orders passed in W.P.No.1005 of 2024 dated 22.01.2024. In the present writ petition, the petitioner seeks for extension of the earlier leave granted by this Court. The reason assigned in the petition is that the convict prisoner is suffering from migraine and the doctors have advised him for treatment.

2. The learned Additional Public Prosecutor, on instructions, submitted that though the convict prisoner was admitted in the Government Hospital, Pollachi, his medical condition is stable.

3. In view of the above fact, we are not inclined to accept the reason assigned by the petitioner for extension of leave, If at all, the convict prisoner is still have medical complication, it is always open to the convict prisoner to approach the Doctors, attached to the concerned jail.

4. The writ petition is dismissed. In view of the dismissal of the above writ petition, the convict prisoner shall surrender before the concerned jail authorities before 5.00 p.m today.
