This Suo motu Contempt Petition has been initiated against the Contemnor as per the order of this Court, dated 1/2/2023 made in W.P.No.2686 of 2023 and W.M.P.No.2784 of 2023.

2. Heard Mr.Govindarasu/Contemnor and Mrs.K.Ashwini Devi, learned Standing Counsel for the respondents. 3.

Today, when the matter is taken up for hearing, MR.R.Govindarasu, filed an affidavit, dated 22/2/2023, wherein it is stated that when the writ petition No.2686 of 2023 was taken up for enquiry on 25/1/2023, he was present with the connected files, so as to coordinate with the standing counsel on record and to enable the learned Additional Advocate General to defend the stand taken by the Corporation, as per the records. Unfortunately, certain facts available on records could not be placed and there was lack of communication between him and junior counsel who was present in assisting the learned Additional Advocate General and as a result of which the learned Additional Advocate General misunderstood the situation resulting in the observation construed to be "same side goal" to the junior counsel on record.

He submitted that it was nothing but exchange of opinion with the junior counsel, who was present to assist the learned Additional Advocate General but only wished to reflect his anxiety to place the correct facts. The intention on his part was neither wilful nor wanton. He tendered his unconditional apology for the inconvenience and embarrassment caused to this Court.

5. On a perusal of the affidavit filed by the Contemnor and unconditional apology tendered by the contemnor, this Court is of the view to drop the Contempt proceedings initiated against the Contemnor.

6. Accordingly, this Suo Motu Contempt Petition is closed. Affidavit filed by the Contemnor shall form part of the records. 1/3/2023 Index : Yes / No mvs.q N. SATHISH KUMAR, J mvs.
