This application has been filed to withdraw the suit in O.S.No.8559 of 2019, pending on the file of the IV Additional City Civil Court, Chennai and to transfer the same to the file of the Commercial Division of this Court for trial/disposal, which was originally filed before this Court as C.S.No.398 of 2008. C.S.No.398 of 2008 was transferred to the City Civil Court, Chennai, on account of change in the Pecuniary jurisdiction of this High Court and renumbered as O.S.No.8559 of 2019.

2. The Court records indicates that all the defendants have been set ex-parte on the following dates:

(a) The first defendant is set ex-parte on 27.10.2022. (b) The second and third defendants are set ex-parte on 17.11.2022. (c) The fourth defendant is set ex-parte on 23.11.2021.

3. The dispute in the present application pertains to alleged violation of copyrights in the Telugu Film "TATA BIRLA MADHYALO LAILA", this Court has Jurisdiction to entertain the suit. Merely because, the 1/2 https://www.mhc.tn.gov.in/judis

arb applicant/plaintiff is asking for damages for Rs.10,00,000/- would not necessarily means the case cannot be tried before this Court. Considering the above, I find sufficient reasons to allow this application. Accordingly, this Application stands allowed.

4. Registry is directed to call for the records relating to this case from the City Civil Court and ensure that the suit papers are transmitted to this Court for recording of evidence and for passing Judgment and Decree in the above suit.
