O R D E R

The Criminal Original Petition has been filed seeking to set aside the order passed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.33011 of 2023 in C.A.No.815 of 2023, dated 02.01.2024, dismissed the petition for suspension of sentence.

2. When the matter is taken up for hearing, the learned Special Public Prosecutor for CBI submitted that the petition in Crl.M.P.No.33011 of 2023 has been dismissed for default only and not on merits. He further submitted that as on today, a Non Bailable Warrant is pending against the petitioner.

3. At this juncture, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Criminal Original Petition and he has also made an endorsement to that effect. He also prayed that liberty may be granted to the petitioner to file an application for bail, before the Court concerned.

4. In view of the above submissions and the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition stands dismissed as withdrawn. However, the petitioner is at liberty to file the bail petition before the Court concerned.
