The petitioner who was arrested and remanded to judicial custody on 07.12.2023 for the offences registered under Section 5(1) r/w. Section 6 of POCSO Act, 2012 in Crime No.39 of 2023, on the file of the respondent police, seeks bail.

2.It is stated that the petitioner is the sister's husband of the victim child. Consequent to the relationship which the petitioner had with the victim child, she became pregnant. It is also stated that investigation has been completed and final report has been filed. 3.But however, the victim child has to be categorized as vulnerable witness. Therefore, till she is examined and cross-examined as a witness, I am not inclined to grant bail to the petitioner.
