Read this in conjunction with and in continuation of separate order made today (18.12.2019) in A.No.5586 of 2019, wherein this Court had permitted the legal heirs of deceased sole plaintiff to be brought on record.

2. This application has been taken out by the deceased sole plaintiff with a prayer to bring on record legal heirs of deceased 11th defendant.

3. In the light of aforesaid trajectory and in the light of the order made in A.No.5586 of 2019 today, Mr.Gagan Bothra, party-in-person has made an endorsement in the case file, which reads as follows: 'Permit to withdraw with a liberty to file fresh application. (sd/-) 18/12/2019 (P-in-P).'

4. Aforesaid endorsement is reiterated in the hearing.

5. This application is dismissed as withdrawn, albeit, preserving the rights of legal heris of deceased sole plaintiff, who have been brought on record vide the orders in A.No.5586 of 2019, to file fresh application with the same prayer.
