The petitioner is the brother of R.Bheem Singh who died on 19.10.2007. The present petition is filed seeking succession certificate in respect of security mentioned in the schedule attached to the petition.

According to the petitioner, his brother R.Bheem Singh died intestate as a bachelor and their parents pre-deceased, except the petitioner there is no other legal heirs to the deceased R.Bheem Singh and therefore, he is entitled to inherit the estate of the deceased R.Bheem Singh, being the sole surviving class II legal heir.

To substantiate his plea, the petitioner has marked the following five documents:- Ex.P1 - Original death certificate of Mr.R.Bheem Singh Ex.P2 - Photocopy of the legal heirship certificate of Mr.R.Bheem Singh E.P3 - Photocopy of the term deposit advice of State Bank of India, Parrys Corner branch 1/4

standing in the name of R.Bheem Singh Ex.P4 - Photocopy of Aadhar card of the petitioner Ex.P5 - Copy of the paper publication effected in one issue of Tamil daily "Makkal Kural" dated 07.07.2024.

Heard the learned counsel for the petitioner and the records perused.

The death of R.Bheem Singh on 19.10.2007 is proved through Ex.P1 - which is the death certificate issued by the Corporation of Chennai. The legal heir certificate which is marked as Ex.P2 shows that R.Bheem Singh, who died on 19.10.2007, has left behind the petitioner Bhagawan Singh as a sole surviving legal heir being his brother. In the petition, it is stated that the deceased R.Bheem Singh has not left Will or testament to succeed his property. The paper notice inviting objection by way of paper publication has not invoked any response. The paper publication is marked as Ex.P.5. The security mentioned in the schedule of the petition is the term deposit lying in the A/c.No.64045801865 in State Bank of India, Parrys Corner Branch, Chennai in the name of the deceased. 2/4

In the light of the above facts and evidence, this Court is satisfied that the petitioner is entitled for the grant of succession certificate in respect of the schedule mentioned security. Therefore, the petition is ordered as prayed. Succession Certificate is granted to the petitioner with power to collect the securities and to receive interest, dividends thereon and negotiate and transfer the securities in the name of the petitioner. 08.11.2024 rpl 3/4
