ORDER

This writ petition has been filed by Mrs.P.Dharani, W/o Saravanan seeking issuance of a writ of certiorarified mandamus, calling for the records of the Notification dated 04.01.2018 issued by the respondent, which was published in the website by rejecting the petitioner's registration No.070309354 as 'Not satisfied the eligibility condition as per the norms stipulated in the Notification', quash the same with a consequential direction to the respondent to include the registration No.070309354 dated 05.05.2015 in the selection list for the interview going to be conducted for the posts included in

Combined Civil Services Examination-II (Interview posts) (GroupII Services) 2014-2015 & 2015-2016, (Code No.004).

2. Heard both sides.

The petitioner was one of the candidates, who had applied for the posts included in Combined Civil Services Examination-II (Interview posts) (Group-II Services) 2014-2015 & 2015-2016, and she was also issued with a call letter with registration No.070309354 to write the written examination. As she was working as a Lab Assistant, she also obtained NOC from the department and after taking part in the written examination, she was also invited to take part in the certificate verification held on 26.10.2017. During the certificate verification, she was was found ineligible, as she had not filled up the application as per the instructions given in the notification.

The learned counsel for the petitioner, drawing the notice of this Court to the copy of the online application submitted by the petitioner, submitted that an inadvertent mistake has been committed by the petitioner while furnishing her educational particulars stating that she underwent the medium of instruction in Tamil for SSLC, HSC and Degree, although she clearly mentioned in the application that she is not claiming any benefit under the Persons Studied in Tamil medium category. That shows that the petitioner had no bad intention to gain any advantage under the PSTM category. Since the petitioner has not been permitted to take part in the oral test, she has come to this Court. Considering the fact that the order of rejection of the application of the petitioner has been questioned in this writ petition, by order dated 16.2.

2018, this Court directed the respondent to permit the petitioner to take part in the oral interview. Now the respondent has to declare the results and if the petitioner is coming within the zone of consideration, a direction may be issued to consider her case, he pleaded.

4. Pursuant to the oral interview, if the petitioner comes within the zone of consideration with the requisite marks, the respondent shall declare her results. With this observation, the writ petition stands disposed of.
