Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the transfer of investigation from 3rd Respondent in FIR No.152 of 2023, J-7, Police Station, Velachery, Chennai, to the 4th Respondent Crime Branch CID

(CBCID) to take over the investigation of the case for further investigation in accordance with law.

ORDER

This Criminal Original Petition has been filed seeking transfer of investigation in Crime No.152 of 2023 from the file of the third respondent to the file of the fourth respondent.

2. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that based on the complaint lodged by the petitioner, the third respondent registered an FIR in Crime No.152 of 2023 for the offence under Section 174 of Cr.P.C. After completion of the investigation, a final report was filed on 02.02.2024, referring the case as "Further Action Dropped". Therefore, no investigation is pending on the file of the third respondent.

3. In view of the above, the question of transfer of investigation does not arise. Hence, this petition is liable to be dismissed. Accordingly, this Criminal Original Petition stands dismissed.
