A.Dharmalingam(Deceased), 1.A.Krishnaveni v. A.Balasubramaniam
C.M.P.No.2455 of 2025 in C.M.A(Sr).No.164943 of 2024 S.SOUNTHAR,J.
The civil miscellaneous petition has been filed to accept the cause title.
2. It is the case of the petitioners that they filed an application to restore the suit which was dismissed for default in I.A.No.4 of 2024 along with one Dharmalingam. Though the said Dharmalingam died even prior to the disposal of the interlocutory application, the death was not reported and the interlocutory application for restoration of the suit was dismissed. Aggrieved by the said order, the petitioners have preferred the civil miscellaneous appeal. Since the legal representatives of the Dharmalingam failed to co-operate with the petitioners, they have been impleaded as respondents 8 to 11 in this civil miscellaneous appeal. Since the names of the legal heirs have not been mentioned in the certified copy of the order passed by the Court below, this civil miscellaneous petition has been filed to accept the cause title. 1/2 https://www.mhc.tn.gov.in/judis
