ORDER

This petition has been filed seeking a direction to the second respondent to register the complaint dated 25.05.2016 in CSR.No.333 of 2016 preferred by the 1st petitioner and to file an FIR and investigate the same and consequently direct the 1st respondent to monitor the investigation of the same.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the Respondents.

3. The learned Additional Public Prosecutor submitted that based on the complaint lodged by the first petitioner, the petition enquiry is pending in CSR.No.333 of 2016 before the second respondent.

4. Recording the submission of the learned Additional Public Prosecutor, the second respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the first petitioner. With the above directions, this Criminal Original Petition is closed.
