ORDER

This writ petition has been filed to direct the 2nd respondent to initiate action to recover the files stated to have been missing from the record room of the 6th respondent as mentioned in his proceedings bearing Na.Ka.No. 714/2021(a1) dated 21.01.2022 and co-relation register pertaining to Survey and

Subdivision of properties in Old S.No. 22/2 and 27/3A, in Selur Nadu Village, Kollimalai Taluk,Namakkal District and furnish the same to the petitioner

2. The learned Additional Government Pleader appearing for the respondent would submit that in this case, one Easaiyan, who worked as surveyor, has taken away all the files. In this regard, the 6th respondent had already initiated action by lodging a criminal complaint in the concerned Police Station against the said Easaiyan and FIR was also registered therein. Now, it was informed that they had traced out some files and some files are still missing, for which, the process of reconstruction is yet to be initiated. Hence, he would submit that nothing survives in this petition and thus, he prays for dismissal of this petition.

3. Heard the submissions and perused the record.

4. Now, the grievance of the petitioner is to initiate action for recovery of files, which are said to have been missing from the 6th respondent. Today, it was submitted by the official respondents that a criminal complaint was already lodged against one Easaiyan, Ex-surveyor, by the 6th respondent with regard to the missing files. Further, it was submitted that some of the files are traced out and the remaining files will be reconstructed at the earliest.

5. In view of the above, it is clear that the grievance of the petitioner is duly addressed by the respondents and nothing survives in this petition. Therefore, this writ petition is closed. No cost. Consequently, the connected miscellaneous petition is also closed.
