This petition is filed to condone the delay of 104 days in filing the above Appeal.

2.The learned counsel for the petitioner submitted that the 1st respondent remained exparte before the Tribunal and no notice is necessary for the 1st respondent.

3.Though notice has been served on the 2nd respondent and their name is printed in the cause list, there is no representation for them either in person or through counsel.

4.Considering the contention of the learned counsel for the petitioner, the delay of 104 days is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) to the 'Kaakkum Karangal' (Old age Home) at No.212/54, Amman Kovil Street (near chicken market), Parrys, Chennai 600
