Though the drafted notice dated 29.08.2016 was served on the petitioner's daughter-in-law, viz., Nishat Hashim, on 12.09.2016, no learned Page 1 / 3

counsel had filed change of vakalat on behalf of the petitioner and inspite of the petitioner's name being printed in the cause list on 16.09.2019, there was no representation for the petitioner. Hence, the Registry was directed to list the matter under the caption "for dismissal" today (i.e.) 17.09.2019. Today also there is no representation for the petitioner. Further, the learned counsel for the respondent submitted that the respondent had already vacated the premises and handed over vacant possession to the petitioner in the year 2017 itself.

2.For the reasons stated above, the Civil Revision Petition is dismissed for non-prosecution. No costs. Consequently, the connected miscellaneous petition is closed.
