THAMILSELVI CRIMINAL MISCELLANEOUS PETITION No.2299 of 2022 IN CRL OP.2106/2022 SIVA @ SIVARAJA [ PETITIONER/ACCUSED ] Vs STATE, REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, MANGALAMEDU POLICE STATION, PERAMBALUR DISTRICT.

(CRIME NO.951 OF 2021).

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Modify the condition imposed in Para No.6(a) of Crl.OP.2106/2022 vide order dated 01.02.2022 that the petitioner has to deposit a sum of Rs.10,000/- to the Registered Advocate Clerks association at Perambalur and pass such further or other orders. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S M.VIJAYA RAGAVAN, Advocate for the petitioner and of M/S.L.BASKARAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- The Petitioner has filed in Crl.O.P.No.2106 of 2022 seeking anticipatory bail in Crime No.951 of 2021 on the file of the respondent police.

This Court considering the submission made on behalf of the petitioner and upon hearing the learned Government Advocate (Crl.Side) and passed on order dated 01.02.2022 imposing certain conditions. One of the condition that the petitioner was directed to deposit a sum of Rs.10,000/-(Rupees Ten Thousand only) to the Registered Advocate Clerks Association, at Perambalur.

2. While, the matter comes to that, the petitioner has filed the present Crl.M.P.No.2299 of 2022 seeking modify the above conditions.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that entire jewels has been recovered by the respondent police.

4. Heard the learned Government Advocate (Crl.Side) appearing for the respondent police.

5. For the reason stated in the affidavit in support of this miscellaneous petition, the condition that the petitioner to deposit a sum of Rs.10,000/-(Rupees Ten Thousand only) to the Registered Advocate Clerks Association, at Perambalur is hereby withdrawn and two weeks time is granted to the petitioner to comply with the other conditions imposed by this Court.
