C.M.P.No.14478 of 2021 in C.M.A.No.507 of 2012 RMT.TEEKAA RAMAN,J., This Civil Miscellaneous Petition is filed to modify the condition clause No.4 in decree dated 16.12.2009 passed by the learned Motor Accident Claims Tribunal, Gudiyattam. The relevant portion of the decree dated 16.12.2009 is extracted hereunder:- "4. That the remaining half of the share amount of the petitioners 1 and 2 should be deposited in any nationalized bank for a period of 3 years".

2. Considering the fact that the accident has taken place on 04.11.2005 and the award was passed on 16.12.2009 and this Civil Miscellaneous Appeal No.507 of 2012 is dismissed along with C.M.A.No.1647 of 2011 by common judgment in the year 2019, I am inclined to modify the award passed by the trial Court dated 16.12.2009 in respect of condition No.4 and hereby permit the petitioners 1&2 to withdraw the entire amount without depositing the amount in any Nationalized Bank.

3. With the above modification, this Civil Miscellaneous Petition is allowed.
