PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to order passed in Na.Ka.No.378/2019/A6 dated 11.09.2020 by the third respondent, accepting the report dated 09.09.2020 of the fifth respondent and the consequent resolution No.8 passed on 10.09.2020 by the sixth respondent and quash the same and direct the third respondent to pass order granting common passage to petitioner's property at No.87, Keelmudalambedu-II, Panpakkam Village, Gummidipoondi Taluk, Tiruvallur District comprised in S.No.162/5, Patta No.387, measuring an extent of 7 1⁄2 cents. ORDER

This writ petition has been filed challenging the order passed in Na.Ka.No.378/2019/A6 dated 11.09.2020 by the third respondent accepting the report dated 09.09.2020 of the fifth respondent and the consequent resolution No.8 passed on 10.09.2020 by the sixth respondent.

The learned counsel for petitioner submitted that the petitioner died long back.

However, the legal representatives of the deceased petitioner did not take any steps to substitute themselves as party to this writ petition. Therefore, this writ petition is dismissed as abated. However, the legal heirs of the petitioner are at liberty to file substitution petition to substitute themselves in the place of the deceased petitioner. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
