ORDER

This Criminal Original Petition has been filed to quash the First Information Report in Crime No.222 of 2025, pending on the file of the first respondent Police.

The case of the prosecution is that petitioner/accused had induced the de facto complainant to join chit and cheated the de facto complainant to the tune of 6.5 lakhs. Hence, the de facto complainant gave a complaint to the first respondent Police against the petitioner. Based on the complaint given by the second respondent, a First Information Report in Crime No.222 of 2025 was registered against the petitioner, for the offence under Section 420 of IPC. 3.

Learned counsel appearing for the petitioner submitted that the petitioner had conducted chit from the year 2012 to 2019 and after 2019, she had not conducted any chit and the de facto complainant gave complaint with a delay of five years and hence, the FIR is liable to be quashed. 4.

Per contra, the learned Government Advocate (Criminal Side) submitted that whether the petitioner closed the chit or not is a matter for investigation. He further submitted that the de facto complainant gave complaint recently on 21.11.2025 alleging that the petitioner had conducted an

illegal chit and cheated the de facto complainant. 5.

Having heard the learned counsel on either side and perused the materials available on record and taking into consideration the submission made by the learned Government Advocate (Criminal Side) that the case was registered recently and that the investigation is at a nascent stage; and whether the petitioner had conducted the chit with permission or not and whether she had closed the chit in the year 2019 are all matters for investigation, this Court is of the view that it would not be proper to interfere at this stage. 6.

Accordingly, this Criminal Original Petition stands dismissed. 10-02-2026 MRN To 1.Inspector of Police, Erumapatty Police Station, Namakkal District.
