ORDER

An affidavit has been filed by the respondent wherein they have stated that after the suit has been decreed, they had changed the trademark ZINCOVIT to ZINCOPLEX FORTE and they have been using the said trademark.

2.The learned counsel for the petitioner would also submit that on verification, the Statement appears to be correct. Further, the respondent has also given an Undertaking that neither the respondent Company nor the Directors would use the ZINCOVIT at any point of time whatsoever in future.
