Petitioner has come up with the present Writ Petition challenging the orders passed by the 2nd respondent vide proceedings (i)No.AOE.1.48484/2005, dated 28.03.2005 and (ii) AOE.1.48484 of 2005, dated 22.04.2005.

2. Heard the learned counsel on either side and perused the material documents available on record.

3. It is seen that, the Petitioner was 50 years old at the time of filing the present Writ Petition. Pursuant to the interim order granted by this Court on 15.11.2005, the Petitioner was reinstated in service to his original post. In any event, the question of effecting transfer may not arise, as the Petitioner is now 65 years old and that, he had already attained superannuation.

4. In view of the above, nothing further survives for consideration in this matter. Accordingly, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, connected W.P.M.P.No.39272 of 2005 is closed. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar To:
