The Writ Petition has been filed in the nature of a Mandamus, seeking a direction against the respondent to register the petitioner's Society and issue certificate of registration.

2.The writ petition had been filed in January 2019. The writ petitioner is Tamil Nadu Union Waste Paper Co-operative Society Limited. When the writ petitioner wanted to register the Society an objection was raised by the respondent claiming that there is yet another Society with a similar name, Tamil Nadu Waste Paper Pickers Co-operative Society in the same area. Registration of two separate societies with the similar names in the same areas by the same registering authority would cause confusion and it is appropriate that the petitioner chooses another name independent of the earlier name which had been sought to be registered. A Writ of Mandamus cannot be issued in this regard. The Writ petition stands dismissed. The petitioner is at liberty to apply for registration in an entirely distinct name before the respondent. 2 / 4
