Prayer: To direct 1 to 6 respondents to remove the encroachment made by the private respondents in survey Nos.55 / 1E, 55/1B in Paavandur Village, Pavandur Post, Sankarapuram T.K., Kallakurichi District and to restore the blocked passage of water path (NEER ODAI PORAMBOKE) in the said survey Nos and subsequently to cancel the DKT patta issued in favour of 7th respondents.

(Order of the Court was made by S.M.Subramaniam J.) Writ Petition has been instituted for a direction to remove the encroachment made by the private respondents in S.Nos.55/1E and 55/1B in PaavandhurVillage, Pavandur Post, Sankarapuram Taluk, Kallakurichi District and to restore the blocked passage of water path (NEER ODAI PORAMBOKE) in the said survey Nos and subsequently to cancel the DKT patta issued in favour of 7th respondent.

2. Learned Additional Government Pleader appearing for R1 to R6 would submit that during inspection, it was found that a water channel is running, but there is no entry in the Revenue Records in this regard.

3. This being the factum, the Authorities have to initiate necessary action, if required to make necessary entry in the Revenue Records or scrutinize previous Revenue Records, if any available and take appropriate action in the manner known to law, by affording an opportunity to encroachers, if any identified. The petitioner is also at liberty to produce records available with him before the competent authority.

4. With the above observations, the present Writ Petition stands disposed of. No costs.
