This writ petition has been filed by the petitioner while the civil suit in O.S.No.189 of 2018 is pending on the file of the District Munsif Court at Tambaram against the third respondent. It is a well settled legal position that no parallel https://hcservices.ecourts.gov.in/hcservices/

proceedings are permitted. When the civil suit is pending, the parties cannot invoke the writ jurisdiction. If any such writ petition is entertained, that would definitely either complicate the proceedings in the pending suit or make the pending suit itself infructuous. Therefore, the writ petition is dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
