ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 303(2) of BNS,2023 r/w. 21(1) and 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.31 of 2026, seek anticipatory bail.
2. The allegation against the petitioner is that the petitioners were involved in illegally quarrying 2 units of Norampu sand from the Silperi Lake. Hence the complaint.
3. The learned counsel for the petitioners would submit that the petitioners are an innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Therefore, he prays for grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.side) would submit that investigation in this case is pending and the petitioners were involved in
illegally quarrying sand from the lake. Hence, she vehemently opposed to grant anticipatory bail to the petitioners.
5. Considering the fact that the petitioners were involved in illegally quarrying sand from the lake and also damage the water body. Hence, I am not inclined to grant anticipatory bail to the petitioners and if the petitioners are granted bail, they will involve in similar activities. Accordingly, this Criminal Original Petition is dismissed.
