JUDGMENT

(Delivered by S.M.Subramaniam J.) The writ order dated 21.12.2017 passed in W.P.No. 33440 of 2017 is under challenge in the present writ petition.

2. The writ petitioner is the appellant before this Court. The father of the appellant late Arumugam died on 07.02.2012 while he was in service. The appellant submitted an application seeking appointment on compassionate ground. The authorities considered the application submitted by the appellant and found that the wife of the deceased employee was employed in Government Department and therefore, the family of the deceased employee is not eligible to avail the benefit of compassionate appointment under the scheme. Thus, the claim was rejected. The writ Court also considered the said ground and rejected the writ petition.

3. Scheme of compassionate appointment is a concession and cannot be claimed as an absolute right. The purpose of compassionate appointment is to mitigate the circumstances arising on account of sudden death of an employee and not to provide one appointment to the family of the deceased. The penury circumstances and other mitigating facts and circumstances have to be assessed for providing appointment on compassionate ground. In the present case, the wife of the deceased employee was employed in Government department. Therefore, the authorities have rightly rejected the

application submitted by the appellant seeking appointment on compassionate ground. Thus, there is no infirmity in the writ order impugned and the same stands confirmed.
