Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.L.CHANDRAKUMAR, Advocate for the petitioner and of MR.K.SARVESHWAR FOR M/S.GIRIDHAR AND SAI, Advocate for the 1st Respondent and of MR.B.DEEPAK NARAYANAN, Advocate for the 4th Respondent and of MR.M.T.ARUNAN, Advocate for the 7th Respondent and of Respondents 2, 3, 5, and 6 not appearing either in person or by an Advocate, the court made the following order:- This petition is filed to condone the delay of 416 days in filing the writ appeal.
2. Mr.K.Sarveshwar for M/s.Giridhar and Sai, learned counsel accepts notice on behalf of the respondent-1.
3. Mr.B.Deepak Narayanan, learned counsel accepts notice on behalf of the respondent-4.
4. Mr.M.T.Arunan, learned counsel accepts notice on behalf of the respondent-7.
5. Though the respondents 2, 3, 5 and 6 are served with notices, there is no representation for them either in person or through counsel.
6. Upon hearing the submission made by the learned counsel for the petitioner/appellant and the learned counsel for the respondents 1, 4 and 7 and on being satisfied with the reasons stated in the affidavit filed in support of the petition, the petition is allowed on condition that the petitioner/appellant shall pay a sum of Rs.2,000/- (Rupees two thousand only) to the Madras High Court Advocate Clerks Welfare Association within a period of two weeks from the date of receipt of a copy of this order, failing which, the order shall stand vacated automatically without further reference to this Court.
7. The Registry is directed to number the appeal upon production of proof of payment of Rs.2,000/-, if it is otherwise in order and list the same for admission.
