This petition has been filed seeking modification of the condition imposed on the petitioner by an order dated 31.10.2023 in Crl.M.P.No.17281 of 2023 in Crl.O.P.No.20361 of 2023. 2.Heard both sides.
3.While granting bail to the petitioner in Crl.O.P.No.20361 of 2023 by an order dated 07.09.2023, a learned Single Judge of this Court had directed that the petitioner should appear before the Principal Sessions Court at Villupuram, on all working days until further orders and later, it was modified by this Court in Crl.M.P.No.17281 of 2023 in Crl.O.P.No.20361 of 2023 by an order dated 31.10.2023 directing the petitioner to appear before the Principal Sessions Court at Villupuram, weekly once i.e., on every Wednesday till completion of trial, except unavoidable circumstances and on all hearing dates. 1/3
4.The learned counsel for the petitioner stated that A1 and A2 had been murdered as a revenge murder and therefore, raises apprehension about the petitioner appearing every week before the trial Court, which would give regularity in his movement to those who are hostile to him.
5.In view of that particular fact, the condition is modified to the effect that the petitioner shall appear before the Principal Sessions Court at Villupuram, during the Court hearing dates in S.C.No.65 of 2022. But however, in order to ensure that he would appear and not abscond once again during the judicial process, the petitioner may produce one further surety namely, a blood surety to stand as his surety to the satisfaction of the learned Principal Sessions Judge, Villupuram. It is seen from the records that the petitioner is 34 years old and therefore, it would only be appropriate that his wife stands as surety.
