..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records of the 4th Respondent in Proceedings Na.Ka.No.2537/A4/2019 dated 21.05.2019 to quash the same and to issue consequential directions to the respondents to regularize the services of the petitioner from the date of her initial appointment on 10.02.2003 and to grant of consequential service and monetary benefits thereof.

ORDER

This writ petition is filed to call for the records of the 4th Respondent in Proceedings Na.Ka.No.2537/A4/2019 dated 21.05.2019 to quash the same and to issue consequential directions to the respondents to regularize the services of the petitioner from the date of her initial appointment on 10.02.2003 and to grant of consequential service and monetary benefits thereof.

The case of the petitioner is that the petitioner was initially appointed as Secondary Grade Teacher in Kalaivani Government Aided School, Karumangalapatti, Salem from 10.02.2003 to 19.08.2004 and thereafter, in Veerlakshmi Government Aided School from 19.08.2004 to 16.10.2004. Subsequently, the petitioner was appointed as Junior Secondary Grade Teacher in Salem Rural Panchayat Union on consolidated pay of Rs.3000/- and joined duty on 07.10.2004. This being so, the petitioner was absorbed as Secondary Grade Teacher in regular time scale of pay from 01.06.2006. Under these circumstances, she has passed Diploma Course in Teacher Education. Thereafter, the petitioner has made a representation on 19.10.2007 and 14.03.2018 before the first respondent seeking regularization of service as Secondary Grade Teacher in regular time scale of pay from the date of her initial appointment in the Aided school right from the year 2003, however the

same was not considered. Hence, she filed a writ petition before this Court in W.P.No.20706 of 2018 and this Court vide its order dated 16.08.2018 directed the respondents to consider and pass order in the light of the order passed in W.P.MD.No.2501 of 2013 dated 22.10.2013. Pursuant to which, the present impugned order dated 21.05.2019 was passed by the fourth respondent, rejecting the petitioner's request for regularization of her service from the initial appointment. Challenging the same, the petitioner has come forward with the present writ petition.

Learned counsel for the petitioner would submit that similarly placed persons like the petitioner has approached this Court for similar relief, by filing W.P.No.6794of 2010, wherein this Court vide its order dated 11.03.2013 directed the respondents to regularize the service of the petitioners therein. Pursuant to the order this Court, the said persons were regularized vide G.O.Ms.No.35, School Education Department dated 10.04.2014. Accordingly, he prays for allowing this writ petition.

Learned Special Government Pleader appearing for the respondents would submit that the petitioner claims that she was initially appointed as Secondary Grade Teacher in the Government Aided school on 10.02.2003. However, no approval order of the Educational Authority was produced before this Court. Whenever the person is appointed in Government Aided school, the

appointment must be approved by the Educational Authority. However, in the present case, there is no approval in favour of the petitioner. Moreover, after a lapse of 15 years, the petitioner has made a representation in the year 2017 for regularization of service from the date of her initial appointment in the Aided school, which is not sustainable. Hence, he prays for dismissal of this writ petition.

5. Heard the learned counsel on either side and perused the materials available on record.

6. The facts in the present case is not in dispute. Admittedly the petitioner's was initially appointed as Secondary Grade Teacher in Kalaivani Government Aided School, Karumangalapatti on 10.02.2003 and Veerlakshmi Government Aided school, Salem on 19.08.2004. However no appointment order or approval pertaining to her initial appointment was produced before this Court. Admittedly, the petitioner was subsequently appointed as Junior Secondary Grade Teacher in Salem Rural Panchayat Union School on consolidated pay on 07.10.2004 and her service was regularized on 01.06.2006. Hence, the claim of the petitioner for regularization from her initial appointment in the Government Aided school is not sustainable.

Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 13-02-2026 Index: Yes/No Speaking/Non-speaking order VM To:
