Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences under Sections 294(4), 323, 506 (1) of IPC and Section 4 of the Tamil Nadu Prohibition of harassment of Woman's Act and seeks anticipatory bail.
2.The learned counsel for the petitioner submitted that as the petitioner questioned the defacto complainant about the waster water stagnation near her house, false complaint has been lodged against her to harass her.
3.Learned Government Advocate (Crl.Side) submitted that it is a wordy quarrel between the neighbours.
4.Considering the facts and circumstances of the case and taking note of the fact that the case pertains to only a neighbourhood dispute, and there is no need for custodial interrogation at this stage, this Court is inclined to grant the relief of anticipatory bail to the petitioner.
5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on her executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Alandur, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., for two weeks and thereafter, as and when required for interrogation.
