This Criminal Miscellaneous Petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.No.491 of 2024 by an order, dated 18.01.2024.

2. By the said order, this Court had granted anticipatory bail to the petitioner, who had been implicated as an accused in Crime No.194 of 2023 registered by the respondent police for the offence under Sections 420 and 506(i) IPC.

3. Among other conditions, this Court had directed the petitioner to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.194 of 2023 before the learned Judicial Magistrate No.I, Bhavani and on such deposit being made, the learned Judicial Magistrate No.I, Bhavani may transfer the same to any fixed deposit account in one of the nationalised bank and the amount should be retained in the bank account till the date of final order. If the petitioner is convicted, the said

amount may be handed over to the defacto complainant with interest. If the petitioner is acquitted, the said amount may be returned to the accused with interest.

5. Considering the submission, the condition imposed as against the petitioner is modified to the effect that the petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Crime No.194 of 2023 on or before 19.03.2024 before the learned Judicial Magistrate No.I, Bhavani and on such deposit, the learned Judicial Magistrate No.I, Bhavani may hand over the amount to the defacto complainant.
