This petition had been filed to call for the records in Crime No.9 of 2018 on the file of the Respondent Police and quash the same.
2. When the case came up for hearing, the learned Counsel for the Petitioner submitted that the Defacto complainant died.
3. The learned Government Advocate (Crl.Side) submitted that though the de-facto complainant died, there is no impediment to proceed with the investigation.
4. Considering the submission of the learned Government Advocate (Crl.Side) that eventhough the Defacto complainant died, there is no impediment in proceeding with the investigation, this Court is not inclined to quash the FIR. Hence, this petition is dismissed with a direction to the Investigating Officer to proceed with the investigation in accordance with law. Consequently, connected Miscellaneous Petition is closed.
