2. It is stated that the suit had been filed under the Provisions of the Trademarks Act, 1999. The defendant is carrying on business in Chennai within the jurisdiction of this Court. The mark of the plaintiff has also been registered at Chennai.

3. However, since primarily the defendant is carrying on business in Chennai within the jurisdiction of this Court, where the infringement had taken place, leave is granted.

4. Application is allowed.
