Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.JAYAPRAKASH, Advocate for the petitioners and of Mr.USHA RAMMAN, Advocate on behalf of the Respondents the court made the following order:- In the suit for partition filed by the first respondent/plaintiff, a preliminary decree has been passed, against which, the present appeal suit has been preferred. 2.Heard the parties. Taking into consideration that the suit is for partition, the trial Court is directed to proceed with the matter except passing of final decree alone.

3.The petition is ordered in the above terms 4.Post the appeal suit in usual course.
